Criminal case about a corrupt R2.5 million tender in July 2009 is still being processed

Minister of Justice and Constitutional Development, Mmamoloko Kubayi, said that a corrupt tender case dating back to July 2009 is still being processed.

Kubayi revealed this in response to a Parliamentary question from National Assembly member Dianne Kohler.

Kohler asked for details about a Directorate of Priority Crime Investigation (DPCI) investigation into a corrupt tender.

It relates to the irregular awarding of a R2.5 million tender in July 2009 by the Ba‑Phalaborwa Local Municipality.

She asked when the National Prosecuting Authority (NPA) received the docket from the DPCI for a decision on prosecution.

She also asked when the NPA intends to announce its decision on whether to prosecute the persons it has found to have acted outside the law.

Kubayi responded, saying the docket was reported to the police on 13 April 2021, and the first referral to the NPA by the DPCI was made on 22 May 2024.

“Upon receipt of the docket from the DPCI, the NPA adopted a prosecutor-guided investigation approach,” she said.

“It held several meetings with the investigation team to follow up on outstanding information and evidence.”

After all the information sought was gathered, the docket was brought to the NPA on 24 June 2026 for consideration.

“The DPP is currently analysing the evidential material and based on the evidence, a decision will be made,” she said.

Kubayi explained that the prosecutors are currently in a consultation process and analysing the evidential material.

“Once the consultations have been concluded, the prosecutor will make a decision on the charges, and if the evidence sustains possible charges,” she said.
